The objective of this Commission study is to analyze what effect the establishment of a legal immigration policy may have on illegal migratory flows and on cooperation with third countries in the fight against illegal immigration. The study first describes the existing measures to manage legal immigration, it then analyzes the relationship between legal and illegal migration flows. Finally, she presents the Commission’s proposals for managing immigration.

Current management of legal immigration

The admission of third-country nationals for employment purposes is carried out differently in each Member State, as it is governed by their national legislation. These laws have been drawn up according to the different migratory trends. Today, procedures and policies aim to meet the needs of the labor market while protecting the interests of the national workforce. Third country nationals wishing to work in the EU must meet certain criteria. They must, for example, have a job offer, sufficient financial resources and health insurance to be granted a temporary residence permit. In some Member States, accelerated or preferential procedures make it possible to attract highly qualified workers in specific sectors, such as health, but also low-qualified workers.

The study carried out by the Commission shows that it is difficult to assess the flows of legal migrants, on the one hand, and to forecast the needs of the labor market on the other. Even though the quality of Community statistics has improved, the sources, definitions, data collection and practices remain different between Member States. However, the report estimates that migration for employment currently affects less than 15% of those admitted to Member States. Most third-country nationals legally admitted to the EU benefit from family reunification or health protection. As for the overall employment forecasts, they show labor shortages in the EU after 2010. In its communication on immigration, integration and employment, the Commission recognizes that immigration will be increasingly necessary in the years to come to meet the needs of the European labor market. But she adds that immigration will not solve the problems caused by the aging of the population for which structural reform will have to be implemented.

In order to admit third-country nationals to their territory, several Member States have bilateral employment agreements. These agreements aim to respond to labor shortages. But they can also be signed to improve relations with third countries, strengthen historical and cultural links, improve the management of migratory flows or fight against illegal immigration. Bilateral agreements signed in recent years have generally focused on the admission of seasonal or temporary workers employed in agriculture, construction, tourism and catering. Spain has, for example, signed agreements with six third countries (Bulgaria, Colombia, Ecuador, Morocco, Dominican Republic and Romania) from which traditionally flows of illegal immigration originate. These agreements have made it possible to strengthen cooperation and the fight against illegal immigration.
